CurrentHUDrulesallow“mixed-status”householdstousepublichousingunderwhatiscalledthe“donotcontend”provision,inwhichapersonlivingamongapublichousingfamilycandeclarethey“donotcontend”theirHUDeligibilityundertheirimmigrationstatus,andthefamilyinsteadreceivesproratedhousingassistance.
TheHUD-ineligiblefamilymemberormembersmayremaininpublichousingsolongasthefamilyacceptstheirdiminishedsubsidies,accordingtoreports.
